Terms of service
Last updated: [DATE]
These terms are an agreement between [COMPANY LEGAL NAME] (“Concourz”, “we”) and the business that creates a Concourz shop account (“you”, the “Shop”). By creating a shop account or using Concourz you agree to them. If you use Concourz for a business, you confirm you can bind that business.
1. The service
Concourz is software for running a vehicle detailing, tint, paint protection film, wrap or repair shop: bookings, check-in, job tracking, client pages, quotes, invoicing, account billing, payments through Stripe, and related tools (the “Service”). We may improve and change the Service. We will not remove a core feature you rely on without reasonable notice.
2. Accounts and staff
- The person who creates a shop account is its owner. The owner can invite staff and remove them, and is responsible for everyone they give access to.
- Keep sign-in email accounts secure. Tell us promptly if you believe your shop account has been used without permission.
- You must be at least 18 and able to form a binding contract.
3. Free trial, plans and billing
- New shop accounts start with a 14-day free trial. No card is needed to start.
- Paid plans are billed monthly in advance through Stripe at the price shown at checkout, plus any applicable taxes. Prices may change with at least 30 days’ notice, effective at your next billing period.
- You can cancel at any time from Manage billing; the plan runs to the end of the period you’ve paid for. Fees already paid aren’t refunded except where the law requires.
- If a payment fails or a plan ends, the Service continues on your devices, and syncing, client pages and online booking pause (after 7 days’ grace for a failed payment) until a plan is active again.
4. Card payments from your clients
- Card payments are processed by Stripe. To accept them you must open a Stripe account through Concourz and agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. Stripe, not Concourz, holds and pays out your funds.
- For each card payment, Concourz keeps a platform fee of [PLATFORM FEE]% of the amount, in addition to Stripe’s own processing fees. The current fee is shown in Settings before you turn card payments on. We’ll give at least 30 days’ notice before raising it.
- You are the merchant for your clients’ payments and are responsible for refunds, disputes and chargebacks, your prices, and any taxes you collect.
5. Your data
- You own the records you put into Concourz, including your clients’ details, vehicles, photos, jobs and prices (“Shop Data”). You give us permission to host, copy, process and display Shop Data only to provide and support the Service for you.
- For your clients’ personal information, you are the business responsible for it and we process it on your behalf, as described in our privacy policy. We don’t sell Shop Data or use it for advertising.
- You can export Shop Data at any time. After an account closes we delete Shop Data from our servers within [90] days, unless the law requires us to keep it, and sooner if you ask.
- We may use aggregated data that doesn’t identify you, your clients or your shop to operate and improve the Service.
6. Messages and pages for your clients
You decide which clients you book and contact. You are responsible for having your clients’ permission to contact them, for the content of the messages and pages you send, and for following the laws that apply to them (including laws on marketing email, texting, privacy, consumer protection, and window tint limits). Emails sent through Concourz go out in your shop’s name.
7. Acceptable use
Don’t use Concourz to break the law, send spam, harass anyone, upload content you have no right to, try to reach other shops’ data, probe or overload the Service, or resell it without our written agreement. We may suspend access that puts the Service, other shops or the public at risk, and will tell you why when we can.
8. Availability and support
We work to keep Concourz available and to fix problems quickly, but there may be interruptions for maintenance or events outside our control. Because each device keeps its own copy, most of the app keeps working offline. Support is by email at .
9. Warranties
The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Features that suggest information, such as reading vehicle details from a photo or suggesting repairs from damage notes, can be wrong; you are responsible for checking them.
10. Limits of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or lost profits or revenue, and our total liability for any claim relating to the Service is limited to the amount you paid Concourz in the 12 months before the claim. Nothing in these terms limits liability that can’t be limited by law.
11. Ending
You can stop using Concourz and cancel at any time. We may end these terms for material breach that isn’t fixed within 30 days of notice, or immediately where the law requires. Sections 5, 9, 10 and 13 continue after the terms end.
12. Changes to these terms
We may update these terms. For material changes we’ll give at least 30 days’ notice by email or in the app. Continuing to use Concourz after the change takes effect means you accept it.
13. Governing law
These terms are governed by the laws of the State of [STATE], without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in [COUNTY, STATE].
